The application period for marijuana business licenses in Delaware commenced on August 19, 2024, and will conclude on September 30, 2024. Interested applicants have a limited window to secure their place in the state’s burgeoning cannabis industry.

Diverse License Options and Categories

Various types of licenses are available, catering to different aspects of the marijuana industry. Prospective business owners can apply for licenses to operate marijuana cultivation facilities, product manufacturing facilities, retail stores, and testing facilities. Each license type comes with unique requirements to meet the industry’s needs.

Among the licenses available, three main categories exist: open licenses, microbusiness licenses, and social equity licenses. Each category has distinct eligibility criteria designed to ensure broad participation and support for historically marginalized groups.

Special Provisions for Social Equity and Microbusiness Applicants

Social equity licenses aim to support individuals from disproportionately impacted areas or those with prior cannabis-related convictions. Applicants must have been residents of these areas for at least five of the preceding ten years or meet other specific criteria to qualify.

Microbusiness licenses cater to smaller operations, with stipulations such as employing no more than 10 employees and operating within a facility no larger than 2,500 square feet. This category seeks to encourage small-scale entrepreneurs to enter the market.

Application Process and Requirements

The application process demands comprehensive documentation from all interested parties. Applicants must provide a detailed business plan alongside safety and security plans, operational and training plans, and other requisite narratives and documents. Thorough preparation is essential for a successful application.

Once applications are deemed eligible, they will be entered into a lottery managed by the Office of the Marijuana Commissioner (OMC) in late October 2024. This system ensures a fair chance for all qualified applicants.

Future Timelines and Post-Lottery Steps

The issuance of licenses will follow a staggered schedule, starting with cultivation licenses in November 2024, manufacturing licenses in December 2024, and culminating in retail licenses in early 2025. This phased approach allows for an organized rollout of the new market.

Conditional license awardees are required to complete a supplemental license application within 30 business days. This application includes final versions of submitted plans and involves passing background checks and financial investigations.

Fees associated with the license applications differ by type: $5,000 for open licenses, $1,000 for social equity licenses, and $3,000 for microbusiness licenses. Successful licensees will receive biennial renewals, ensuring continued adherence to regulatory standards.
